Two events—Hurricane Katrina and the Paterno court decision making the state liable for damages caused by levee failures—have raised large warning flags about the dangers of developing land in flood plains. AB 802 (Wolk) would have elevated the attention given to flood management in the local planning process by requiring that flood management be considered in the conservation element of a general plan.
